Mediation & Conflict Resolution

It’s common for conflict to occur in the workplace, however it is important that the conflict is acknowledged and carefully managed so that the issue doesn’t escalate and become disruptive. 

Conflict can severely impede a Company’s ability to run efficiently and can damage employee well-being. Conflict can increase employee turnover, absenteeism levels, affect morale, as well as having a negative effect on productivity levels.

If the conflict cannot be resolved internally, mediation is an option which has been proven to be highly effective and successful.

Mediation is a process in which an independent, neutral mediator assists two or more disputing parties in resolving the dispute in a collaborative, consensual manner. Mediation can be a way of creating a more harmonious workforce and working environment.  It also reduces costs as it can be a way of resolving issues for a Company before they get out of hand and become costly through litigation.

Mediation helps the parties understand the reasons behind the conflict and agrees on ways of future interaction and behaviour. The most important principles of mediation are:

1. Voluntariness

The voluntary commitment of both parties is essential for the mediation’s success – both parties are free to leave the process at any time, at which stage the mediation will end. Both parties are then free to use the other dispute resolution options available to them if they wish.

2. Impartiality

The mediator remains impartial at all times and does not take any sides or make judgements Mediation is not about disputing parties blaming each other and it is not about who is right or wrong – it is about understanding what has happened, where things may have gone wrong and agreeing on a way forward.

3. Confidentiality

Discussions during the mediation process and any agreements remain confidential at all times unless both parties agree otherwise. 

4. Outcome

Any agreements or decisions are made by the parties themselves and not dictated by the Mediator.
